Each time you access or use www.applocum.com and/or our mobile device application (collectively the “Website”), you are deemed to accept these terms and conditions.

“we” means AppLocum LTD, and “our” shall be construed accordingly. “you” means the person firm company or organisation browsing and/or using the Website, and “your” shall be construed accordingly. “AppLocum LTD Family” means all companies connected with us. A company is connected with us if it is: (i) a subsidiary or holding company of us; (ii) controlled by the same person(s) who control us or our holding company; (iii) a subsidiary or holding company of any company in (i) or (ii) above; or (iv) in the same group as any company under (i), (ii) or (iii) above. “subsidiary” and “holding company” shall be as defined in section 1159 of the Companies Act 2006. The term “control” shall have the same meaning as defined in Section 416 of the Income and Corporation Taxes Act 1988. Two companies are in the same group if they share the same ultimate holding company.

Interruptions and Omissions in Service
Whilst we try to ensure that the standard of the Website remains high and to maintain the continuity of it, the internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. We do not accept any liability arising from any such errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate the Website (or any particular part of it) or to provide the service offered on the Website. We may vary the specification of this site from time to time without notice.

AppForum: Your Obligations
In these Terms and Conditions, your “user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to our site (AppLocum website, app and any other forum), for whatever purpose. You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to us the right to sub-license these rights, and the right to bring an action for infringement of these rights. You warrant and represent that your user content will comply with these Terms and Conditions. Your user content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or us or a third party (in each case under any applicable law). You will, when accessing or using this Site (AppLocum website, app and any other forum), or any Service (and regardless of whether posting as yourself or anonymously where permitted) adhere to the obligations as set out in these Terms and Conditions. Failure to comply with your obligations may, at the discretion of AppLocum, result in your account being terminated.
When accessing or using AppLocum Site (website, app and any other forum), or any Service, you will:

  1. Act in a professional and ethical manner at all times.
  2. Ensure that your user content is appropriate, civil, tasteful and in accordance with generally accepted standards of etiquette and behaviour on the internet.
  3. Ensure that your user content adheres to the standards set out by your professional regulatory body’s code of conduct.
  4. Not to post the same or similar messages multiple times in the same forum or in multiple forums; or use the Site or Services in any way that constitutes negligent advice or contains any false or inaccurate statements or constituting spam.
  5. Not post chain letters of any type, or post files to newsgroups not specifically named for that purpose.
  6. Not harass any person. Harassment in this instance includes you being intimidating, threatening, abusive, hostile or otherwise offensive towards another person.
  7. Not cause annoyance, inconvenience, or needless anxiety to any person. (Any comments posted that imply that another member is suffering from mental illness are considered to contravene these Terms and Conditions.).
  8. Not post or send any libellous, defamatory, obscene, derogatory, blasphemous, menacing, offensive, pornographic, or indecent material to this Site or via any Service.
  9. Not to be in breach of racial or religious hatred or discrimination legislation.
  10. Not use the Site or Services to post or upload any message or material that consist of or contains any instructions, advice or other information which may be acted upon and could cause illness, injury or death, or any other loss or damage.
  11. Not flame, hack, or obtain unauthorised access to any data or system.
  12. Not introduce into this Site or any Service, any virus, logic bomb, harmful code, Trojan horse, or anything else that might corrupt, damage, or render inaccessible any software, data or system.
  13. Not be involved in any criminal or unlawful activity or post any confidential patient information or information or material which might be legally actionable or disclose anonymised information from which a patient could still be identified. GMC regulations on patient confidentiality and consent must be adhered to.
  14. Not seek redress from AppLocum if you suffer loss or damage, or if you are harmed, defamed, or offended by material, information, products, or services which you accessed or obtained through, or which were posted on this Site or any Service.
  15. Not use the Site or Services in any way that constitutes an incitement to commit a crime; be in contempt of any court, or in breach of any court order; be in breach of official secrets legislation.
  16. Comply with all applicable laws, regulations, and conventions, including those related to privacy, personal data, international communications, or the export of technical data.
  17. Not use the Site to link to any website or webpage consisting of or containing material that would, were it posted on the Site, breach provisions of these Terms and Conditions
  18. Not submit any user content to the Site that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint; and
  19. Not use the Site or Services in any way that would infringe any copyright, moral, trademark, design right, or any intellectual property rights of any person and all necessary permissions must be obtained before use of any such rights.

Information Submitted by You
We will and/or the AppLocum Ltd Family will use information supplied by you to aid the recruitment process and associated administrative functions as well as to facilitate the purchase of training courses made through this website. We will process any data which you provide in completing the online registration or application forms and any further forms, assessments, or personal details which you complete or provide to us when using the Website in accordance with relevant data protection legislation. We explain more about your personal data in our Privacy Policy.

Transfer outside the EEA: Personal information comprising your CV may be accessed through the AppLocum.com database by third parties outside the European Economic Area (“EEA”). This could happen for instance if you apply for a vacancy where the employer is based outside the EEA.

Terms of Business
Recruitment: Each employment assignment or placement arising as a result of an introduction made by AppLocum will be subject to our standard Terms of Business as they are applicable in the circumstances. All prospective employers and clients for whom we arrange assignments or placements will be provided with a copy of the Terms of Business applicable to them at or following registration. Separate terms and conditions also apply to the use of our Recruiter site.

Training Courses: Any training course purchased through this website will be subject to the terms issued by the course providers.

Content Rights
The rights in material on the Website are protected by international copyright, software and trademark laws and you agree to use the Website in a way which does not infringe these rights. You may copy material on the Website for your own private or domestic purposes, but no copying for any commercial or business use is permitted.

Security and Passwords
In order to register with the Website and to sign in when you visit the Website, you will need to use a username and password. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times and not disclosed to any other person. You must notify us immediately if you believe that your password is known to someone else or if it may be used in an unauthorised way.
